On June 1, 2026, in Talbott v. United States, the U.S. Court of Appeals for the D.C. Circuit blocked Trump’s discriminatory transgender military ban, affirming a March 2025 preliminary injunction barring the military from discharging transgender service members.

On May 6, 2026, a transgender woman filed a federal lawsuit against the U.S. Department of Justice (DOJ), challenging a December 2025 DOJ memorandum that suspended longstanding federal regulations protecting incarcerated transgender people from sexual abuse under the Prison Rape Elimination Act.
On March 8, 2026, a federal granted a preliminary injunction in Gordon v. Aetna, a class action civil rights lawsuit challenging Aetna’s categorical coverage exclusion on gender-affirming facial reconstruction surgeries for transgender women. The court also denied Aetna’s motion to dismiss the lawsuit.
